A leading law firm require a Regulatory Solicitor with at least 2 + year's PQE to join a professional disciplinary department in Birmingham working with a significant number of regulatory bodies.
 
The Firm
A leading provider of legal services to the health, social care, housing and emergency services sectors, as well as in the field of professional discipline.  The firm has over 400 staff and act for a wide range of long standing clients in both the public and private sector, including all forms of NHS organisations, governmental and regulatory bodies, registered providers, insurers, police, fire and rescue services, independent health and social care providers, charities and GP practices.
  
The Role
 
The role will work in a department who act for a significant number of regulatory bodies, primarily in the health sector but, increasingly, more widely across a number of professional disciplines.  
 
The work requires managing an investigatory case load where it is alleged that the registrant's fitness to practise is impaired through misconduct, competence or health issues and preparing those cases for hearings before panels and committees of the relevant regulators. The work is varied, challenging and rewarding and the cases cover everything from large-scale fraud or multi-patient clinical failings through to inappropriate sexualised behaviour.
 
Main Duties and Responsibilities
 
Solicitors carry out the day-to-day conduct of the regulator's cases under the supervision of a partner and with the assistance of a paralegal.  In summary, solicitor caseholders:
 
·Prepare the case plan at the outset of the case;
·Prepare advice on procedural or evidential issues;
·Correspond with the defence;
·Ensure that all factual evidence required to prove the allegations is obtained;
·Are the key point of contact for all witnesses;
·Interview key witnesses in complex cases or if the witness deals with novel or sensitive issues or is a vulnerable witness;
·Supervise witness statements taken by paralegals;
·Instruct experts and identify if any amendments are necessary to the expert report;
·Prepare instructions to counsel (both our internal advocates and the external bar);
·Attend conferences with counsel;
·Ensure that all action points following the conference are completed;
·Either draft the charge or review the draft charge against the evidence if drafted by counsel;
·Carry out disclosure of unused material;
·Liaise with the defence in the run up to the hearing;
·Supervise the preparation of the hearing bundle by the paralegal;
·Attend hearing at outset only, unless there are legal issues or problems with the case;
·Seek instructions from the client on any issues that arise in the course of the hearing;
·Prepare final reports at the conclusion of a case; and
·Present cases to Practice Committees/Interim Orders Committees.
 
This list is not exhaustive and there may be other duties as reasonably required.
 
The Candidate 
 
Previous experience in the field of regulation and professional discipline is strongly preferred, it is not essential as a qualified. Candidates will however be expected to be able to demonstrate at interview that they are self-motivated and commercially minded, as well as having good interpersonal skills and being able to work effectively in teams.
 
Salary between £51,000 to £65,000

The role
The Clinical Law department comprises around 80 fee earners and the role will deal with clinical negligence work, the department carries out a wide range of other work which includes inquests, advising on regulatory matters, public law issues, judicial reviews, mental health issues and clinical risk management.
 
The Candidate
A self-motivated, ambitious and experienced solicitor or senior solicitor, with at least 2+ year's to join a highly regarded and expanding clinical negligence/medical malpractice litigation team.  The successful candidate will be expected to have litigation experience and well-versed in understanding the needs of our client base, preferably gained at a NHS Resolution Panel firm, together with experience of handling and advising on cases involving complex issues and maximum severity injuries. Experience of managing claims against GPs is an advantage but not essential.  Candidates will have 2 years + of PQE. The role will involve managing a caseload of claims on instructions from NHS Resolution. Successful candidates will have the opportunity to work closely with a partner who will supervise your work and there will be opportunities for client contact and business development.
 
Salary to £71,000

The work largely involves presenting cases but also requires managing an investigatory caseload where it is alleged that the registrant's fitness to practise is impaired through misconduct, competence or health issues and preparing those cases for hearings before panels and committees of the relevant regulators.
Advocacy typically involves interim and substantive hearings. This includes shorter more straightforward hearings as well as more complex cases such as sexual misconduct, dishonesty allegations/ fraud and serious instances of deficient professional performance. Hearings are usually contested and in the majority of cases the registrants are represented, most often by counsel.  It is likely that there will also be opportunities to appear in the High Court and the First Tier Tribunal on appeals from decisions of the regulators. Depending on experience, there are likely to be other advocacy opportunities arising from other aspects of the department's work.
The Candidate
A qualified Barrister with at least 2+ year's call, ideally, with previous experience in the field of regulation and professional discipline is strongly preferred, it is not essential.

The Role - Will be part of a department that  carries out a full range of commercial property work including development and construction work for its health, social care and housing clients from across the voluntary, public and private sectors. This includes major hospital and housing developments. The team also advises on energy infrastructure projects. The construction role is for a non-contentious construction lawyer (4+ years PQE) that will be required to undertake a wide range of high quality and complex work for both public sector and independent sector clients including health and energy sector clients.  
The role will involve responsibility for a caseload as well as working closely with the Partners and Solicitors of both the Real Estate and Housing teams on business development opportunities. A genuine interest in growing business from existing clients as well as targeting and attracting new clients is therefore very important.
